These Terms of Service ("Terms") govern your use of built4it.co.uk and purchases made from Built4it Ltd ("Built4it", "we", "us" or "our").

Please read these Terms before placing an order. By placing an order through our website, you agree to these Terms together with any policies expressly incorporated into them.

Nothing in these Terms excludes, restricts or replaces any statutory rights available to consumers under applicable UK law.

Our ecommerce store is hosted using Shopify, which provides the online platform through which our products are offered for sale.


2. Policies Forming Part of These Terms

The following Built4it policies should be read together with these Terms where applicable:

If there is any inconsistency between these Terms and a mandatory right provided by UK consumer law, the statutory right will take priority.


3. Consumer and Business Customers

Some rights referred to in these Terms apply specifically to consumers.

A consumer is generally an individual acting wholly or mainly for purposes outside their trade, business, craft or profession.

If you purchase goods wholly or mainly for business, trade, craft or professional purposes, you may be treated as a business customer and different legal rules may apply.

Where we expressly agree additional commercial terms with a business customer, those agreed terms may supplement these Terms.


4. Using Our Website

You may use our website for lawful purposes, including browsing our products, obtaining information and placing legitimate orders.

You must not:

  • use the website for fraudulent or unlawful purposes;
  • attempt to gain unauthorised access to the website, customer accounts, servers or systems;
  • introduce viruses, malicious code or other harmful technology;
  • interfere with the operation or security of the website;
  • impersonate another person or submit deliberately false information;
  • use automated tools to scrape, harvest or reproduce substantial parts of our website without permission;
  • infringe Built4it's intellectual-property rights or those of another person; or
  • use the website in a manner that violates applicable law.

We may restrict or suspend website access where reasonably necessary to protect customers, our systems, our business or third parties from fraud, misuse, security threats or unlawful activity.


5. Placing an Order

When placing an order, you are responsible for checking that:

  • the products and variants selected are correct;
  • the quantities are correct;
  • your billing and delivery information is accurate;
  • your contact information is current; and
  • any promotional or discount code you wish to use has been entered before completing checkout.

Our checkout provides an opportunity to review your order before payment is submitted.

Submitting an order constitutes an offer to purchase the products shown in that order.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted the order.

Unless we expressly tell you otherwise, a contract for the purchase of goods is formed when we accept the order by confirming dispatch, supplying the goods, or otherwise expressly confirming acceptance.


6. Our Right to Decline or Cancel an Order

We may decline or cancel an order before dispatch where there is a reasonable commercial or legal reason to do so, including where:

  • a product is unavailable;
  • we cannot obtain authorisation for payment;
  • fraud or misuse is reasonably suspected;
  • the delivery address cannot reasonably be serviced;
  • an order exceeds a reasonable purchasing or stock limit;
  • the order appears to be for unauthorised resale or distribution;
  • there has been an obvious pricing, stock or product-description error; or
  • we are legally prohibited from completing the transaction.

If we cancel an order after payment has been taken and no goods are supplied, we will refund the amount paid for the cancelled goods and any applicable delivery charge.


7. Products, Specifications and Images

We take reasonable care to ensure that product descriptions, specifications, measurements, photographs and other information on our website are accurate.

Product photographs are intended to provide a fair representation of the goods. Colour and appearance may vary slightly depending upon lighting, manufacturing batches, screen settings and device displays.

Measurements described as approximate may be subject to reasonable manufacturing tolerances.

We may make minor technical, material, manufacturing or cosmetic improvements to products from time to time where those changes do not materially reduce the product's functionality or quality.

If goods supplied are materially different from their description, your statutory rights are unaffected.


8. Product Compatibility

Where compatibility dimensions, thread sizes, device sizes, mounting requirements or other technical information are published, customers should check those details before ordering.

If you are unsure whether a product will work with a particular device, vehicle, machine, camera, tablet or mounting arrangement, please contact us before ordering and provide sufficient information for us to assist.

Where you make a particular intended purpose known to us and reasonably rely upon our advice, nothing in these Terms removes any statutory rights concerning fitness for purpose.


9. Prices

Prices displayed on the website are the prices applicable at the time shown and may change for future orders.

Any applicable taxes and compulsory charges will be shown as required before you complete the order.

Delivery charges, where applicable, will be displayed before checkout is completed.

A price change made after a contract has been formed will not change the agreed price for that existing order unless required by law or expressly agreed with you.


10. Pricing and Listing Errors

Although we take reasonable care when maintaining our website, an obvious pricing, description, stock or promotional error may occasionally occur.

If we identify an obvious error before accepting or dispatching an order, we may contact you to:

  • confirm whether you wish to proceed at the correct price or specification; or
  • cancel the affected item and provide a refund.

We will not deliberately use this provision to avoid honouring a genuine advertised price or promotion.


11. Payment

Payment must be made using a payment method offered at checkout.

Payment services may be provided by Shopify, card networks, banks, PayPal or other payment providers.

We do not guarantee that every payment method will be available for every customer, order or location.

If a payment is reversed, rejected, charged back or otherwise not successfully completed, we may withhold dispatch or take reasonable steps to recover sums properly due.


12. Stock Availability

Products may occasionally sell out or become temporarily unavailable.

Stock information displayed on the website is provided in good faith but may be affected by simultaneous orders, inventory corrections, damaged stock or other operational circumstances.

Where an item becomes unavailable after you order, we will contact you and offer an appropriate solution, which may include:

  • waiting for replacement stock;
  • an alternative product where you agree;
  • a partial order where appropriate; or
  • cancellation and refund of the unavailable item.

13. Backorders and Pre-Orders

Where Built4it expressly allows a product to be purchased as a backorder or pre-order, payment may be taken before the product is available for immediate dispatch.

Any expected stock-arrival or dispatch date given for a backorder is an estimate unless expressly stated to be guaranteed.

We will take reasonable steps to keep customers informed if there is a significant change to an expected backorder timescale.

Your statutory cancellation rights are not removed merely because an order is a backorder or pre-order.


14. Special Orders and Products Made to Specification

Built4it may agree to source components, assemble products or provide configurations to meet particular customer requirements.

Availability, price and expected lead time for a special order will depend upon the components and work required.

Where goods are genuinely made to a customer's specifications or clearly personalised, statutory change-of-mind cancellation rights may not apply where the law provides an exception.

We will not treat an ordinary stock product as non-returnable merely because a customer selected one of our standard variants or configuration options.

Faulty-goods rights are unaffected by a lawful change-of-mind cancellation exception.


15. Delivery

Delivery options, charges, dispatch arrangements and estimated delivery times are governed by our Shipping & Delivery Policy and the information displayed at checkout.

Unless a delivery service is expressly described as guaranteed, dispatch and delivery dates are estimates.

Where consumer law applies, Built4it remains responsible for ensuring goods are properly delivered in accordance with the contract.

Risk in goods supplied to a consumer normally passes when the goods come into the physical possession of the customer or a person identified by the customer to receive them, except where applicable law provides otherwise.


16. Delivery Information Supplied by Customers

You are responsible for supplying complete and accurate delivery information.

If delivery is delayed or fails because an incorrect or incomplete address was supplied, we may ask you to pay reasonable additional costs actually incurred in arranging redelivery where the law permits.

This does not apply where the delivery problem resulted from an error by Built4it or the delivery provider for which Built4it remains legally responsible.


17. Cancellations, Returns and Refunds

Consumer cancellations, our voluntary 60-Day Built4it Returns Policy, refunds, exchanges and faulty-goods procedures are set out in our Returns, Refunds & Warranty Policy.

The Built4it 60-day extended return facility is additional to statutory consumer rights and does not replace them.

Where statutory cancellation rights apply, they remain available regardless of any shorter administrative process stated elsewhere on the website.


18. Faulty Goods and Statutory Rights

Consumer goods supplied by Built4it must meet the standards required by applicable law, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description.

Nothing in these Terms restricts a consumer's statutory remedies where goods are faulty, unsafe, incorrectly supplied, misdescribed or otherwise fail to conform to the contract.

19. Built4it Commercial Warranties

Selected products include an additional Built4it commercial warranty.

The applicable warranty period and any product-specific conditions are those stated on the relevant product page or warranty information at the time of purchase.

A commercial warranty is provided in addition to statutory consumer rights and does not replace or reduce them.

Warranty coverage does not ordinarily extend to damage caused solely by misuse, accidental damage, inappropriate installation, unauthorised modification, normal wear and tear, unsuitable third-party equipment or use outside clearly stated product limitations.


20. Installation and Safe Use

Built4it products include mounts and accessories intended for use in vehicles, construction plant, machinery and other demanding environments.

Customers are responsible for installing products correctly and ensuring that:

  • the selected mounting surface is suitable and secure;
  • all clamps, suction cups, fasteners, joints and fittings are properly engaged and tightened;
  • the mounted device is securely retained;
  • the installation does not obstruct controls, visibility, safety equipment or required access;
  • the product and mounting surface are checked periodically during use; and
  • any supplied instructions and product-specific limitations are followed.

Mounting systems may require periodic inspection and adjustment, particularly when exposed to vibration, temperature changes, dirt, moisture, repeated repositioning or demanding working environments.

A device holder or mount should not be treated as crash-protection equipment or as a guarantee that a device will remain attached during an accident, collision, extreme impact or circumstances outside the product's stated operating purpose.

Nothing in this section excludes liability where a product itself is defective or where liability cannot legally be excluded.


21. Driving and Operating Machinery

Built4it products must be positioned and used responsibly.

You must not install or use a product in a way that unlawfully obstructs your view, interferes with vehicle or machine controls, compromises safety equipment or breaches applicable road, workplace or site rules.

Do not operate, adjust or interact with a phone, camera or other device while driving or operating machinery where doing so would be unsafe or unlawful.


22. Promotions, Discount Codes and Offers

From time to time Built4it may offer promotional prices, discount codes, bundle offers, free items or other incentives.

Unless the particular promotion states otherwise:

  • promotions apply only during the stated promotional period;
  • discount codes must be entered before completing checkout;
  • discount codes have no cash value;
  • multiple promotional codes may not be combinable;
  • a promotion may be limited to specified products, customers or quantities; and
  • promotions are subject to available stock.

A failure to enter an available promotional code before completing an order does not automatically create an entitlement to a retrospective discount, although Built4it may provide one as a goodwill gesture.

Promotional terms will not be used to remove statutory consumer rights.


23. Free and Bundled Products

Where a complimentary or discounted item is supplied only because a qualifying product or bundle was purchased, that item forms part of the promotional transaction.

Any return consequences relating to free or bundled items are described in our Returns, Refunds & Warranty Policy.


24. Customer Reviews, Photographs and Content

We welcome genuine customer reviews, photographs, videos and feedback.

You retain ownership of original content that you create.

Where you knowingly submit a review, photograph, video or other content to Built4it for publication or promotional use, you grant Built4it a non-exclusive, royalty-free licence to reproduce, display, format and share that content for reasonable Built4it website, social-media, advertising and marketing purposes.

This licence does not automatically apply to photographs, videos or information supplied privately solely for customer-service, warranty or troubleshooting purposes.

You confirm that content submitted for publication:

  • is genuinely yours or you have permission to provide it;
  • does not deliberately contain false or misleading information;
  • does not infringe another person's intellectual-property or privacy rights; and
  • does not contain unlawful, threatening or defamatory material.

We may moderate or remove published customer content where reasonably necessary, including where it is unlawful, abusive, fraudulent, irrelevant, contains personal information or violates these Terms.

We will not remove a genuine negative review merely because it is critical of Built4it.


25. Intellectual Property

Unless otherwise stated, the Built4it name, branding, logos, website design, original product photographs, graphics, written content and other original materials are owned by or licensed to Built4it.

You may view and use the website for normal personal or business purchasing purposes.

You must not reproduce, commercially exploit, republish or distribute substantial parts of our protected content without permission, except where permitted by law.


26. Third-Party Services and Links

Our website may integrate or link to services operated by independent third parties, including payment providers, couriers, social-media platforms and other technology providers.

Independent third-party websites and services may have their own terms and privacy policies.

Built4it is not responsible for content or services supplied independently by a third party where that third party, rather than Built4it, is contracting directly with you.

Nothing in this section removes responsibility that Built4it has for fulfilling its own contract with you.


27. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Cookie and privacy choices are also available through the privacy controls provided on our website.


28. Website Availability

We aim to keep our website available and functioning correctly but cannot guarantee uninterrupted access at all times.

The website may occasionally be unavailable because of maintenance, upgrades, technical faults, third-party platform outages, security incidents or other operational circumstances.

Where reasonably possible, we will take appropriate steps to restore normal service.


29. Errors and Corrections

We may correct genuine typographical, technical, pricing, stock or descriptive errors on the website.

Corrections made to the website will apply prospectively and will not be used unfairly to rewrite an existing consumer contract after it has been formed.


30. Liability to Consumers

Nothing in these Terms excludes or limits Built4it's liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory consumer rights;
  • defective goods where liability cannot legally be excluded; or
  • any other matter for which liability cannot lawfully be excluded or limited.

If we breach our contract with a consumer, we are responsible for loss or damage that is a foreseeable consequence of that breach or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase as a consumer, we are not responsible for business losses such as loss of profit, revenue, business opportunity or commercial interruption arising from a purchase made wholly for private purposes.


31. Business Customers

If you purchase wholly or mainly in connection with a trade, business, craft or profession, the consumer-specific provisions of these Terms may not apply.

For business customers, to the extent permitted by law, Built4it will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business opportunity or loss of anticipated savings arising from the purchase or use of goods.

Nothing in this section excludes liability that cannot lawfully be excluded or limited.

Any additional limitation agreed for a substantial trade, wholesale or bespoke commercial order will be set out separately where appropriate.


32. Events Outside Our Reasonable Control

We will not be treated as being in breach merely because performance is temporarily prevented or delayed by circumstances genuinely outside our reasonable control, such as severe weather, major transport disruption, industrial action, natural disasters, widespread network failures or similar events.

Where such an event materially affects an order, we will take reasonable steps to minimise the effect and keep you informed where appropriate.

This section does not remove statutory rights to cancel or obtain a refund where those rights arise because of the duration or effect of the delay.


33. Suspension or Termination of Website Access

We may suspend or terminate an account or website access where reasonably necessary because of serious or repeated misuse, fraud, unlawful conduct, threats to security or material breach of these Terms.

Suspension of website access does not automatically cancel an existing paid order or remove any rights or obligations that have already arisen.


34. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, website, technology or legal requirements.

The version applicable to an order will normally be the version in effect when that order was placed.

We will not use a later change to these Terms to retrospectively remove or materially reduce contractual or statutory rights relating to an existing order.

The latest version will be published on this page together with its Last Updated date.


35. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary, while the remaining provisions will continue to apply.


36. No Waiver

If Built4it does not immediately exercise a right available under these Terms, that does not automatically mean that the right has been waived.


37. Entire Agreement

These Terms, together with the policies and information expressly incorporated into the contract, set out the agreement relating to your purchase and use of our online store.

Nothing in this section excludes responsibility for representations that cannot lawfully be excluded or for information that forms part of a consumer contract under applicable law.


38. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory consumer protections applicable to you and may have the right to bring proceedings in the courts available to you under applicable law.

Business customers agree that the courts of England and Wales will have jurisdiction, except where we expressly agree otherwise in writing.
